This Liability Waiver and Release Form (“Waiver”) is executed as of the date signed below by the undersigned attendee (“Participant”) in favor of Adventure Awaits Events, its owner, its directors, officers, employees, agents, affiliates, successors, and assigns (collectively referred to as the “Organizer”).
1. Assumption of Risk:
The Participant acknowledges that participation in the Fables & Flames – Romantasy Gala (“Event”) may involve certain risks, including but not limited to personal injury, property damage, or other losses. These risks may arise from the consumption of alcohol, the presence of attendees in costume, or other activities and conditions related to the Event. The Participant voluntarily assumes all such risks, whether foreseen or unforeseen, known or unknown.
2. Release of Liability:
In consideration of being permitted to attend the Event, the Participant, on behalf of themselves and their heirs, assigns, personal representatives, and next of kin, hereby releases, waives, and discharges the Organizer from any and all claims, liabilities, demands, causes of action, or damages of any kind, arising out of or related to the Participant’s attendance at or participation in the Event, including but not limited to those resulting from the consumption of alcohol or interactions with other attendees in costume.
3. Alcohol Consumption:
The Participant acknowledges that alcohol will be served at the Event and agrees to consume alcohol responsibly. The Participant affirms that they are of legal drinking age and understands that excessive consumption of alcohol may result in injury or other risks. The Participant assumes full responsibility for their own conduct and any consequences resulting from their consumption of alcohol.
4. Costume and Behavior:
The Participant acknowledges that attendees may wear costumes and engage in character roleplay. The Participant agrees to respect the boundaries and personal space of all attendees and to behave in a manner that is safe and respectful. The Organizer is not responsible for any injuries, misunderstandings, or disputes arising from interactions with other attendees in costume.
5. Indemnification:
The Participant agrees to indemnify, defend, and hold harmless the Organizer from any and all claims, liabilities, damages, or expenses (including attorney’s fees) arising out of or related to the Participant’s conduct at the Event, including but not limited to damage to property, injury to others, or violation of any laws or regulations.
6. Medical Treatment:
The Participant consents to receive medical treatment deemed necessary in the event of an injury, accident, or illness during the Event. The Participant releases the Organizer from any claim arising out of such treatment.
7. Media Release:
The Participant grants the Organizer permission to use photographs, video recordings, or other media of the Event that may include the Participant for promotional, marketing, or other purposes without compensation.
8. Governing Law:
This Waiver shall be governed by and construed in accordance with the laws of the state of Minnesota, without regard to its conflict of law provisions.
9. Severability:
If any provision of this Waiver is found to be unenforceable, the remaining provisions shall remain in full force and effect.
By buying a ticket, the Participant acknowledges that they have read and understand this Waiver, and they voluntarily agree to its terms.
